RainClock is a service operated by Harper AI, Inc., a Delaware corporation operating from California (“RainClock,” “we,” “us”). By using this site you agree to these terms. RainClock provides rain-triggered inspection scheduling, inspection logging, and record-keeping tools for construction stormwater (SWPPP) programs.
What this service is, and is not
RainClock is record-keeping software. You perform and attest your own inspections; RainClock records them and reminds you. We are not an inspector, an engineer, or a SWPPP preparer. We do not prepare, review, or certify stormwater pollution prevention plans, and we certify nothing about your compliance. The “qualified person” your permit requires, and that person’s training, are yours. Nothing on this site is legal, engineering, or environmental advice, and no professional relationship is created between you and us.
RainClock is a private product. We are not affiliated with, endorsed by, or operated by the U.S. Environmental Protection Agency, the Texas Commission on Environmental Quality, or any other government agency.
Rain data and clocks
Rain figures come from public NOAA precipitation data (MRMS multi-sensor estimates), which the permits treat as a representative-station-class source. These are estimates for a grid cell near your site, not a certified gauge reading; you can record your own on-site gauge reading as an override on any event. We disclaim absolute precision of rain data and of any schedule computation built on it. The duty to inspect is the operator’s regardless of our notifications. A missed or late notification does not transfer that duty to us.
Your records
Inspection records, photos, corrective actions, and rain logs you create belong to you. We do not share, sell, or report them to anyone, including regulators. We respond to valid legal process only as required by law, and where lawful we will notify you before producing your records. Export of your binder is always available, including after cancellation.
Your permit likely requires keeping inspection records for at least three years. Deletion tools in the product warn you when a deletion would reach into that window; completing such a deletion is your decision and your responsibility.
Accounts
Keep your account email accurate and your sign-in access to it secure. You are responsible for activity under your account. We may suspend accounts that violate these terms.
Acceptable use
- No scraping, bulk extraction, or resale of the service or its data.
- No unlawful use, and no use to misrepresent inspection history — records carry the timestamps at which they were made.
- No attempts to probe, disable, or overload the service.
Payments
Pricing is shown at purchase and billed monthly through Stripe. The refund policy describes cancellation (self-serve, anytime) and refunds. Renewal terms are disclosed and consented to at checkout.
Disclaimer of warranties
The service is provided “as is” and “as available,” without warranty of any kind, express or implied. We do not warrant that rain data is precise, that notifications are timely or complete, or that use of the service will produce any regulatory outcome, including the absence of violations, penalties, or enforcement.
Limitation of liability
To the maximum extent permitted by law, Harper AI, Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for fines, penalties, or enforcement outcomes arising from your permit obligations. Our total liability for any claim is capped at the amounts you paid us in the twelve months before the claim arose. Your remedy if you are unhappy with the service is to export your records and stop using it.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
Changes
